  1. The consumer has the right to withdraw from the purchase contract within 14 days from the date of receipt of the goods according to § 1829, paragraph 1 of the Civil Code. b) the delivery of goods that are perishable, as well as goods that have been irreversibly mixed with other goods after delivery,

    c) the delivery of goods that are hygienic goods or personal care items

    d) goods that are opened, partially consumed, or used.

  3. In the case of withdrawal from the contract no later than 14 days from this fact, the buyer shall return or send back the goods received under this contract. When sending goods, choose a registered shipment; do not send goods cash on delivery. The costs of returning the goods are borne by the buyer. The goods should be sent back undamaged and unused, and if possible, in the original packaging. The buyer should also attach a copy of the payment document, invoice, delivery note, or other proof to demonstrate that the goods were purchased from us within 14 days prior to the withdrawal from the contract. This will significantly speed up the processing of the request. However, the failure to present these documents does not prevent the processing of the withdrawal from the contract. No later than 14 days from the delivery of the goods back to the seller, the consumer will be refunded the payment for the goods, including shipping costs and any other costs incurred for the delivery of the goods.According to the law, the consumer will be refunded an amount corresponding to the cheapest offered delivery of the goods, regardless of the form of delivery chosen and its cost. We will return the money to you in the same way you paid us (i.e., for example, by bank transfer). Therefore, in such a case, the seller will only return the difference between the purchase price (including shipping costs) and the amount corresponding to the incurred damage.html

  4. The seller reserves the right to withdraw from the purchase agreement if it is no longer possible to deliver the goods for reasons not on their side (e.g., it has ceased to be produced, cannot be imported, etc.). 5. The buyer is also entitled to withdraw from the contract in cases specified by law, the purchase agreement, and these terms and conditions for reasons stated in the law, the contract, or the terms and conditions. html

  6. If a gift is provided to the buyer along with the goods, the gift agreement between the buyer and the seller is concluded with a suspensive condition, namely if the buyer withdraws from the contract without giving reasons, the gift agreement becomes ineffective and the buyer is obliged to return the gift provided by the seller no later than 14 days from the withdrawal from the contract.

  7. The subscription can be viewed, modified, or canceled in the customer account, via a direct link in the subscription confirmation email, payment processing, or shipment of goods, or by email at expedice@ecohaus.cz.  ;

  8. The subscription can be terminated at any time. In the event that the subscription is canceled after processing and charging for the next subscription interval, it is considered that the subscription is canceled from the following month. The paid goods will be delivered in the manner chosen in the subscription. If payment for the given subscription interval cannot be processed and the customer does not update the payment details after being prompted by the seller (payment cannot be processed for more than one month), it is considered that the subscription is canceled. VII. Rights from defective performance The seller guarantees the buyer that the goods are free from defects upon receipt. In particular, the seller guarantees the buyer that at the time the buyer took over the goods:

  • the goods have the properties that the parties agreed upon, and if there is no agreement, they have such properties that the seller or manufacturer described or that the buyer expected with regard to the nature of the goods and based on the advertising conducted by them,

  • the goods are suitable for the purpose that the seller indicates for their use or for which goods of this kind are usually used,

  • the goods correspond in quality or execution to the agreed sample or template, if the quality or execution was determined according to the agreed

  • the goods are in the appropriate quantity, measure, or weight and

  • the goods comply with the requirements of legal regulations.

  • The seller's obligations for defective performance are at least to the extent that the manufacturer's obligations for defective performance last. The buyer is otherwise entitled to assert a right for a defect that occurs in consumer goods within twenty-four months from receipt.
  • If the sold goods, their packaging, the instructions attached to the goods, or the advertisement state, in accordance with other legal regulations, the period during which the goods can be used, the provisions on quality warranty shall apply. The quality warranty means that the seller commits that the goods will be suitable for use for their usual purpose for a certain period or that they will retain their usual properties. If the buyer has legitimately pointed out a defect in the goods, the time limit for asserting rights from defective performance and the warranty period do not run for the duration during which the buyer cannot use the defective goods.

  • The provisions stated in the previous paragraph of the terms and conditions do not apply to goods sold at a lower price due to a defect for which the lower price was agreed upon, nor to goods that are worn out from normal use, to used goods in the case of a defect corresponding to the degree of use or wear that the goods had at the time of receipt by the buyer, or if it follows from the nature of the goods. The right to defective performance does not belong to the buyer if they knew about the defect before receiving the goods, or if the defect was caused by the buyer themselves.

  •   In case of a defect, the buyer may submit a complaint to the seller and request:

    • exchange for new goods,

    • repair of the goods,

    • reasonable discount on the purchase price or

    • withdrawal from the contract. html

  •    The buyer has the right to withdraw from the contract if:

    • the goods have a substantial defect,

    • they cannot properly use the item due to a repeated occurrence of a defect or defects after repair or

    • in the case of a larger number of defects in the goods. html

  • A significant breach of contract is one that the breaching party was aware of at the time of the contract's conclusion, or when one party must have known that the other party would not have entered into the contract had it anticipated this breach.
  • In the case of a defect that constitutes a minor breach of contract (regardless of whether it is a removable or non-removable defect), the buyer is entitled to have the defect remedied or to a reasonable discount on the purchase price.

  • If a removable defect occurs repeatedly after repair (usually this is the third complaint for the same defect or the fourth for different defects) or if the goods have a greater number of defects (generally at least three defects simultaneously), the buyer has the right to request a discount on the purchase price, exchange the goods, or withdraw from the contract.

  • When making a complaint, the buyer is obliged to inform the seller of which right they have chosen. A change of choice without the seller's consent is only possible if the buyer requested a repair of a defect that turns out to be unremovable. If the buyer does not choose their right from a substantial breach of contract in time, they have the same rights as in the case of a non-substantial breach of contract. The buyer may  use this form for claiming goods of a textile nature.

  • If repair or replacement of the goods is not possible, based on withdrawal from the contract, the buyer may request a full refund of the purchase price.

  • If the seller proves that the buyer was aware of the defect in the goods before acceptance or caused it themselves, the seller is not obliged to comply with the buyer's claim.

  • The buyer cannot claim discounted goods for the reason for which the goods were discounted.html

  • The seller is obliged to accept a complaint at any establishment where the acceptance of the complaint is possible, or at the registered office or place of business. The seller is obliged to issue a written confirmation to the buyer stating when the buyer exercised the right, what the content of the complaint is, and what method of resolution the buyer requests, as well as confirmation of the date and method of resolving the complaint, including confirmation of the repair performed and its duration, or a written justification for the rejection of the complaint.

  • The seller or an authorized employee will decide on the complaint immediately, in complex cases within three working days. This period does not include the time reasonably required according to the type of product or service needed for a professional assessment of the defect. Claims, including the removal of defects, must be processed without delay, no later than 30 days from the date of the claim, unless the seller and buyer agree on a longer period. The expiration of this period is considered a substantial breach of contract, and the buyer has the right to withdraw from the purchase agreement. The moment of filing a claim is considered to be the moment when the buyer's expression of will (assertion of rights from defective performance) reaches the seller. The seller will inform the buyer in writing about the outcome of the claim. The right to claim for defective performance does not belong to the buyer if the buyer knew that the item had a defect before taking possession of it, or if the buyer caused the defect themselves.html

  • In the case of a justified complaint, the buyer has the right to reimbursement of the reasonably incurred costs associated with the exercise of the complaint. This right can be asserted by the buyer with the seller within one month after the warranty period has expired; otherwise, the court may not grant it.

  • The buyer has the choice of how to make a complaint.

  • The rights and obligations of the contracting parties regarding rights from defective performance are governed by § 1914 to 1925, § 2099 to 2117, and § 2161 to 2174 of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection.

Out-of-court resolution of consumer disputes ends

    • by concluding an agreement between the parties to the dispute (voluntary),

    • by a unilateral declaration of the consumer to terminate participation in the dispute resolution notified to the Czech Trade Inspection or an authorized entity,

    • by rejecting the proposal (due to its defects).

Out-of-court resolution of consumer disputes is not charged. The costs associated with out-of-court resolution of consumer disputes are borne by the parties themselves.

The Czech Trade Inspection Authority or an authorized entity will establish rules for the out-of-court resolution of consumer disputes, which will detail the procedure for out-of-court resolution of consumer disputes to ensure compliance with legal regulations.

In the event that the out-of-court resolution of a consumer dispute does not lead to a resolution, you can always turn to the court. Of course, you also do not have to use the option of out-of-court resolution of a consumer dispute (although it is always recommended) and you can directly approach the relevant court for the resolution of the consumer dispute.html

        10. When making a complaint, the buyer is obliged to inform the seller of which right they have chosen. A change of choice without the seller's consent is only possible if the buyer requested a repair of a defect that turns out to be non-removable. The seller or an authorized employee will decide on the complaint immediately, in complex cases within three working days. This period does not include the time reasonably required for the professional assessment of the defect, depending on the type of product or service. Complaints, including the removal of defects, must be handled without delay, no later than 30 days from the date of the complaint, unless the seller and the buyer agree on a longer period. The expiration of this period is considered a substantial breach of the contract, and the buyer has the right to withdraw from the purchase contract. The moment of filing a complaint is considered the moment when the buyer's expression of will (assertion of rights from defective performance) reaches the seller.

        16. The seller will inform the buyer in writing about the outcome of the complaint.

        17. The right to claim for defective performance does not belong to the buyer if the buyer knew that the item had a defect before taking possession of it, or if the buyer caused the defect themselves.html

        18. In the case of a justified complaint, the buyer has the right to reimbursement of the necessary costs incurred in connection with the exercise of the complaint.
